One of the First NEC 2023 States — And One of the Best-Structured Solar Markets in the Midwest

Permit Design produces Minnesota solar permit plan sets for solar installers, EPCs, and roofing companies across every Minnesota county. Minnesota adopted the 2023 National Electrical Code effective July 1, 2023, placing it among the earliest NEC 2023 adopters in the United States. The Board of Electricity administers NEC 2023 under Chapter 1315 of the Minnesota State Building Code, covering electrical wiring, apparatus, and equipment statewide. Electrical permits filed on or after July 1, 2023 must comply with the 2023 NEC — there is no ongoing transitional window or pending edition change in Minnesota as of mid-2026.

Minnesota net metering under Minn. Stat. §216B.164 requires all Minnesota utilities to offer net metering for systems up to 40 kW. But the compensation structure differs critically by utility type. Xcel Energy (Northern States Power-Minnesota), serving the Twin Cities metro and much of central and southern Minnesota, must provide 1:1 net metering at the full retail rate — the value of exported electricity equals what the customer would have paid for it. Minnesota Power, Otter Tail Power, Connexus Energy, and the state's rural electric cooperatives compensate net metering at the utility's average retail rate, which differs from 1:1 full retail. What Is a Community Solar Garden?
Under Minn. Stat. §216B.1641, a Community Solar Garden (CSG) is a centralized solar installation — typically 1-5 MW — whose electrical output is shared among multiple subscribers. Residential and commercial customers subscribe to a portion of the CSG's output and receive bill credits for their subscribed share. CSGs make solar accessible to renters, homeowners with shaded or unsuitable roofs, and businesses without adequate rooftop space.
