Minnesota adopted NEC 2023 effective July 1, 2023 — one of the earliest NEC 2023 adopters in the country. Xcel Energy customers receive 1:1 full retail net metering under Minn. Stat. §216B.164 and can access the Solar*Rewards performance incentive. But Minnesota Power, Connexus Energy, Otter Tail Power, and the state's many rural cooperatives credit net metering at the "average retail rate" — a meaningfully different structure. Minnesota's nationally recognized Community Solar Garden program adds another project type requiring NEC 2023 plan sets. Minnesota adopted the 2023 National Electrical Code effective July 1, 2023, placing it among the earliest NEC 2023 adopters in the United States. The Board of Electricity administers NEC 2023 under Chapter 1315 of the Minnesota State Building Code, covering electrical wiring, apparatus, and equipment statewide. Electrical permits filed on or after July 1, 2023 must comply with the 2023 NEC — there is no ongoing transitional window or pending edition change in Minnesota as of mid-2026.
Minnesota net metering under Minn. Stat. §216B.164 requires all Minnesota utilities to offer net metering for systems up to 40 kW. But the compensation structure differs critically by utility type. Xcel Energy (Northern States Power-Minnesota), serving the Twin Cities metro and much of central and southern Minnesota, must provide 1:1 net metering at the full retail rate — the value of exported electricity equals what the customer would have paid for it. Minnesota Power, Otter Tail Power, Connexus Energy, and the state's rural electric cooperatives compensate net metering at the utility's average retail rate, which differs from 1:1 full retail. This distinction changes system sizing economics, and Permit Design confirms which compensation structure applies to every Minnesota project by address before finalizing plan set documentation.
Minnesota is also nationally recognized for its Community Solar Garden (CSG) program under Minn. Stat. §216B.1641, allowing multiple subscribers to share the output of a single larger solar installation — making solar accessible to renters, multi-family households, and commercial customers without suitable rooftops. CSG project developers building the underlying solar gardens require the same NEC 2023 and Minnesota State Building Code plan sets as any direct rooftop installation, scaled to the CSG project's capacity.
